Terms of Service

1. Acceptance of terms

By creating an account or using the Flagify platform, you agree to these Terms of Service. If you are using Flagify on behalf of an organization, you represent that you have the authority to bind that organization to these terms.

If you do not agree with these terms, do not use the service.

2. Description of service

Flagify provides a feature flag and remote configuration platform that enables developers to control feature releases, perform targeted rollouts, and manage application behavior in real time. The service includes:

• The Flagify dashboard for managing flags, environments, and team members
• Server-side and client-side SDKs for flag evaluation
• REST and streaming APIs for programmatic access
• Documentation, changelogs, and support resources

3. Accounts

You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and API keys. Notify us immediately at [email protected] if you suspect unauthorized access.

You are responsible for all activity that occurs under your account, including actions taken by team members you invite to your organization.

4. Acceptable use

You agree not to:

• Use Flagify to store sensitive personal data (health records, financial account numbers, government IDs) in flag targeting attributes
• Attempt to reverse-engineer, decompile, or extract source code from the Flagify platform (excluding open source SDKs)
• Exceed documented API rate limits or abuse the service in a way that degrades performance for other users
• Use the service for any unlawful purpose or to facilitate illegal activities
• Resell, sublicense, or redistribute access to Flagify without written permission
• Interfere with or disrupt the integrity or security of the platform

5. Plans and billing

Free plan

The Free plan includes limited flag evaluations, environments, and team seats as described on our pricing page. Flagify reserves the right to modify Free plan limits with 30 days notice.

Paid plans

Pro and Enterprise plans are billed monthly or annually, in advance. Prices are listed on our pricing page and are subject to change with 30 days notice for existing subscribers.

Upgrades and downgrades

Plan changes take effect immediately. When upgrading, you are billed the prorated difference. When downgrading, the new rate applies at the start of the next billing cycle. No refunds are issued for partial billing periods.

Cancellation

You may cancel your subscription at any time from the dashboard. Your access continues until the end of the current billing period. After cancellation, your data is retained for 30 days before deletion.

6. Data ownership

You retain all ownership of the data you submit to Flagify, including flag configurations, targeting rules, and user context attributes. Flagify does not claim any intellectual property rights over your data.

You grant Flagify a limited license to process your data solely for the purpose of providing and improving the service. This license terminates when you delete your data or close your account.

7. Service availability

We target 99.9% uptime for flag evaluation APIs and the Flagify dashboard. Current uptime status is available on our status page.

We may perform scheduled maintenance with reasonable advance notice. Maintenance windows are communicated through the dashboard and our status page. We are not liable for downtime caused by factors beyond our reasonable control, including third-party infrastructure outages, natural disasters, or cyberattacks.

8. SDK and open source

Flagify SDKs are released under the MIT License. Your use of the SDKs is governed by the MIT License terms in addition to these Terms of Service. The Flagify platform (dashboard, API, backend services) is proprietary.

9. Intellectual property

Flagify, the Flagify logo, and associated branding are trademarks of Flagify. The platform, its design, and underlying technology are protected by intellectual property laws. These terms do not grant you any rights to use Flagify trademarks without prior written consent.

10. Limitation of liability

To the maximum extent permitted by law, Flagify is not liable for any indirect, incidental, consequential, or punitive damages arising from your use of the service. This includes lost revenue, data loss, or business interruption.

Our total liability for any claim related to the service is limited to the amount you paid us in the 12 months preceding the claim, or $100, whichever is greater.

Flagify provides local evaluation through its SDKs, meaning flag evaluations continue working even if connectivity to our servers is temporarily interrupted. However, we do not guarantee uninterrupted or error-free operation of the platform.

11. Indemnification

You agree to indemnify and hold harmless Flagify and its team from any claims, damages, or expenses arising from your use of the service, your violation of these terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account if you violate these terms, fail to pay applicable fees, or engage in activity that threatens the security or availability of the platform. We will provide reasonable notice where possible.

Upon termination, your right to use the service ceases immediately. We retain your data for 30 days after termination to allow for export, after which it is permanently deleted.

13. Governing law

These terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles. Any disputes arising from these terms will be resolved in the state or federal courts located in Delaware.

14. Changes to these terms

We may update these terms from time to time. Material changes will be communicated via email or dashboard notification at least 30 days before they take effect. Continued use of the service after changes take effect constitutes acceptance of the updated terms.
